These Terms of Use are governed by the laws of the State of Victoria, Australia. You irrevocable and unconditionally submit to the exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts and waive any right to object to proceedings being brought in those courts.
1. Introduction
AMA Group Limited (ACN 113 883 560) (AMA) is pleased to offer its customers with a lifetime warranty on the workmanship comprising the repairs services performed by us on your vehicle (Services), subject to the terms and conditions set out below.
2. Limited Warranty.
Subject to the obligations and exclusions below, AMA warrants the repairs against defects in workmanship for the applicable period of time set forth in section 2.a. During such time, AMA will repair or replace any parts which prove to be defective by reason of improper workmanship without charge for parts or labour relating thereto. All warranty repairs must be performed at one of AMA’s facilities.
This warranty only applies going forward as of October 2025.
Except as otherwise provided herein, AMA warrants the repairs and paint only to you and for only as long as you own the vehicle. You may not expressly or implicitly transfer or assign any rights granted under this limited warranty.
In certain instances, AMA may use parts, materials, or accessories in its repairs that have been procured from third-party manufacturers and/or suppliers. In such instances, AMA warrants such parts, materials, or accessories only to the extent that the third-party manufacturer or supplier’s warranties apply to AMA.
This limited warranty does not apply to repairs necessitated by any cause beyond the reasonable control of AMA, including any defects, damage or malfunctions caused by or resulting from unauthorised service or parts, improper or inadequate vehicle maintenance, use for which any parts or accessories were not designed or approved, alterations, accidents, modification of repairs, subsequent repairs performed by a party other than AMA (except as specified in this section 2), abuse, misuse, neglect, acts of God or fair wear and tear.
This limited warranty does not apply to damage caused by chemicals, tree sap, road salt, sand, rocks, pebbles, hail, windstorms, sun, animal droppings, pollution or other environmental factors or road hazards that may damage cloth, leather, plastic, wood, vinyl, paint, chrome, upholstery and/or convertible tops.
By entering into these terms and conditions, you waive any right to the return of auto parts replaced by AMA and agree that all parts replaced under this limited warranty shall become the property of AMA.
3. Disclaimers
Clause 2 above sets out the complete limited warranty for AMA repairs and supersedes all other warranties and representations, whether oral or written. Except as expressly stated, no other express warranties are made with respect to AMA repairs. In no event will AMA be liable to you for any repair services provided, for any commercial damages, expenses, lost revenues, lost savings or any other special, indirect, incidental, or consequential losses of a commercial nature whatsoever, even if AMA has been advised of the possibility of such damages. To the extent that any part of this limited warranty is in conflict with applicable law, AMA will follow such applicable laws, including the Australian Consumer Law.
4. Entire Terms and Conditions, Headings, Validity.
You acknowledge that you have not been induced to authorise repairs by any representation or warranty not set forth in these terms and conditions. This is the entire agreement between AMA and you, and these terms and conditions supersede all existing agreements and all other oral or written communication between them concerning its subject matter.
5. General
AMA reserves the right to amend these terms and conditions at any time without notice to you.
If any of these terms and conditions are invalid or unenforceable, they may be struck out and the remaining terms and conditions will continue in full force and effect.
No waiver of any breach of these terms and conditions will be construed as a waiver of any other breach of these terms and conditions.
6. Governing Law
These terms and conditions shall be governed by the laws of the State of Victoria, Australia. The parties irrevocable and unconditionally submit to the exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals form those courts and waive any right to object to proceeding being brough in those courts.
